The Additional Advocate General made a submission to the court in response to a PIL seeking holding of examination afresh.

A two-judge bench of the High Court at Hyderabad comprising acting Chief Justice Ramesh Ranganathan and Justice U Durga Prasad Rao on Tuesday made clear that it “would not like to be seen running the government from this small room.”

Giving clear message, acting Chief Justice Ramesh Ranganathan said that the powers of the Executive were clearly delineated and this court would not, except in extraordinary circumstances, tread the territory.

The bench made observations in a writ filed by S Mahender Raju, a practising advocate, seeking directions to the State government to conduct fresh entrance examinations for MBBS and BDS for the ensuing academic year.

It is the case of the petitioner that the scam relating to leakage of question papers had nullified the credibility of the examination purpose. S Satyam Reddy appearing for the petitioner pointed out that even a single incidence was sufficient to vitiate the examination process.

Additional Advocate General Ram Chander pointed out that the investigating agency had already identified 103 cases of such malpractice where 103 identified beneficiaries of the malpractice were taken to places like Bengaluru, Cuttack, Pune and Mumbai and trained to take the EAMCET-II examination on the basis of the leaked question paper.
