The High Court at Hyderabad has permitted the Greater Hyderabad Municipal Corporation (GHMC) to reject the applications made under Building Regularisation Scheme (BRS) when they were found not eligible for regularisation. 

The High Court at Hyderabad has permitted the Greater Hyderabad Municipal Corporation (GHMC) to reject the applications made under Building Regularisation Scheme (BRS) when they were found not eligible for regularisation.

It has also wanted the GHMC to keep aside those applications that qualify for regularisation, but not pass any orders on them until the petition before it is pending.

A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice A Shankara Narayan passed this order while hearing a public interest litigation petition filed by Secretary of Forum for Good Governance M Padmanabha Reddy, challenging the amendment to GHMC Act, and G.O. MS No.s 146 and 152 issued by Municipal and Urban Development Department for BRS. The Court had passed interim orders earlier stopping all proceedings for BRS.

The counsel for petitioner Sivaraju Srinivas brought to the notice of the bench that taking advantage of the interim order granted by the court staying all proceedings related to BRS, some were going ahead and completing the structures illegally.

Many had applied for BRS with only walls in place and now they were completing the structures as their applications were not rejected.
