Hyderabad: The VI Additional MM Court at LB Nagar on Friday convicted the accused N Janardhan Naidu (45), for three years rigorous imprisonment and imposed fine of Rs 10,000 in a cheating case.

According to police, on 24 April 2015, police received a Court referred complaint from one J B Rao (57), in which he stated that the accused approached him and expressed his willingness to settle the matter of repayment of some amount and accordingly the said matter, was referred to Lok Adalat for compromise.

Where, the accused entered into a separate MOU on 22 April 2008 agreeing to pay the amount of Rs 6 lakh to complainant within six months.

Despite several reminders and demands, the accused failed to meet with the award passed by the Legal Services Authority.

Aggrieved by the same, the complainant preferred execution petition before the Principal Senior Civil Judge Ranga Reddy district and after the filling of the said EP, the accused paid a sum of Rs 2.5 lakh towards part satisfaction of the EP amount Rs 6.9 lakh which includes interest of 18 percent under receipt dated 4 January 2012.

Subsequent to that no payment was made by the accused. The said EP was dismissed for default as his counsel for the petitioner failed to pursue the same property due to his health reasons.

Taking the dismissal of the EP the accused never put any efforts to pay the balance amount due under the award passed by the Lok Adalat and avoiding the payment till date even though he was bound to repay the amount to the complainant.
