Hyderabad: YSR Congress Party honorary president YS Vijayamma on Monday demanded that the Assembly Speaker adopt a resolution requesting President Pranab Mukherjee to refer the drat AP Reorganization Bill -2013 back to Union government to reexamine the need for repealing of article 371 (D).
She submitted a letter to Assembly Secretary R Sadaram and urged him to adopt a resolution under rule 77 and 78 of AP Legislative Assembly business rules.
“This House resolves to request the President of India to refer the draft AP Reorganisation Bill - 2013 back to the Union Cabinet to reexamine the said draft Bill with reference to the need for repealing Art 371D and Art 371E (forming part of VII Schedule to Constitution of India) as per the procedure laid down in Art 368 of the Constitution before any action on reorganisation of the State is initiated under Article 3 of the Constitution of India.”
Vijayamma also said otherwise it would be ultra vires the provisions of Art 4 of the Constitution, which provides that amendment under Art 368 is not required only in respect of amendments of the First Schedule and the Fourth Schedule for giving effect to the provisions of the law.”
She also requested that the Speaker agree for a shorter period of 10 days as he is empowered to do so under Rule 77 in view of the importance and urgency of the matter.
