• Mandatory competitive bidding for allocation of all natural resources

The Lok Satta Party (LSP) has suggested several amendments to the Prevention of Corruption Act (PC Act) which the government seeks to push through in the Vote on Account budget session which would he held in February.

The Bill, that seeks to punish bribe-givers and confiscate illicit gains from government employees, was introduced in the Rajya Sabha on August 19 and referred to the House panel on August 23, 2013, for its consideration.

A delegation led by LSP national president Jayaprakash Narayan and nine other leaders submitted far-reaching amendments to the Prevention of Corruption Act with a view to eradicate all pervasive corruption.

The amendments include - Time-bound justice and day-to-day trials, definition of corruption be widened to include gross perversion of the Indian Constitution, abuse of authority to favour or harm others, obstruction of justice and squandering public resources even when no personal gain was involved; A distinction is sought between extortionary corruption (one has to pay bribe for getting job done) and collusive corruption (both the giver and taker equally participate in the graft);

Provisions for confiscation of property in line with the draft Bill in the Law Commission’s 166th report;

Automatic prosecution in graft or disproportionate assets cases; In other cases, the sanction of prosecution must vest with the Vigilance Commission or the officer of a rank of the Cabinet Secretary;

If prosecution not sanctioned within a specified time limit, it should be deemed to have been given; the party opposed deletion of the section providing immunity to the bribe giver in the present PC Act.
