​New Delhi: The Centre on Wednesday categorically put the onus for the delay in the bifurcation of the High Court on the AP Government.

In a review of the two-year performance of the NDA Government, Union Law Minister Sadananda Gowda said the Centre was committed to implement all provisions of the AP Reorganisation Act, 2014.

However, in case of the High Court, the AP Government should come forward with its proposal to establish the High Court. The State Government should provide the funds, basic infrastructure and other facilities and seek the bifurcation.

Sadananda Gowda said that there was no delay on part of the Centre or his Ministry at all. The Law Ministry was ready to bifurcate the High court as the existing High Court would become the Telangana High Court "naturally".

The reason for the delay was that the AP Government had not come forward with the details of infrastructure and facilities in place.
Neither the State Government nor the Chief Minister of AP gave their consent for the same.

“Unless the AP Chief Minister agreed for the bifurcation and the establishment of a new court in his State, there was little that the Centre could do,” Sadananda Gowda clarified to a question posed by the Telugu media.

Moreover, a case was pending with the High Court of Judicature, Hyderabad, in this regard and the Centre would act on its directive. The Telangana Government has been insisting on the bifurcation of the High Court "as the interests of the Telangana government and Telangana people would be adversely affected in the absence of their own high court".

Chief Minister of Telangana K Chandrasekhar Rao, his party MPs, State Ministers and lawyers have approached the Centre repeatedly on this count, but the Centre could not make a move.

Some quarters even blamed the Centre for the delay accusing it of being partisan towards AP Chief Minister N Chandrababu Naidu and delaying the bifurcation.With this clarification on Wednesday, the ball now lies in the court of AP as far as the High Court bifurcation is concerned.
