The court acted on a petition by the NGO, People's Union for Democratic Rights. The Supreme Court had ruled earlier this year that a death sentence can be commuted to life because of a long delay in a decision on a convict's mercy plea. On Tuesday, the Supreme Court had rejected Koli's petition seeking a review of his death sentence.

Meanwhile, Koli has written a letter to Obama seeking his intervention for a “free and fair investigation” into the case.
Koli has been sentenced to death for his role in the case in which over two dozen children were killed in the house of Moninder Singh Pandher in Nithari of Noida between 2005 and 2006.

In his four-page letter to the president of the United States of America, Koli has said the actual culprit in the case was his former master Pandher, who was protected by the police. He has alleged that Pandher used his money power to save himself, while implicating Koli.
