New Delhi: Additional Sessions Judge Yogesh Khanna will pronounce the quantum of punishment on Friday in the brutal Delhi gangrape case of December 16, 2012. After hearing arguments of the prosecution and the defence counsel on the quantum of punishment on Wednesday, the Judge reserved the judgment. Prosecution pleaded for death to all the four found guilty, while the defence counsel pleaded for leniency.

“I am innocent,” shouted one of the four convicts, while the defence counsel A P Singh sought to invoke Mahatma Gandhi to suggest that “if one cannot give life, one cannot take away life.” As such, death sentence should not be given but only life-term. Life-term is the rule, while death is an exception.

Public Prosecutor Dayan Krishnan strongly argued for death penalty before the court. He prayed before the court show no mercy for merciless convicts. It was a premeditated crime, which fell in “the rarest of the rare category, warranting the death sentence,” he argued. Dayan Krishnan said, “There can be no better example than this case. They showed no mercy even when she prayed for mercy. There should be no mercy for merciless convicts.”

The girl's parents were present at the District and Session Court in Saket in the capital in anticipation of the quantum of punishment, which was to be pronounced on Wednesday. The parents were clear that nothing short of death sentence will be justice enough.

Additional Sessions Judge Yogesh Khanna found the four guilty on as many as 13 counts. The Judge went on to point to the brutality and barbarity committed on the young girl, when he referred to the 18 internal injuries caused by an iron rod that was used to beat her male friend and violate her.

Mother of the girl bitterly cried and said, “I can never forget how she wept in the hospital and said they beat her so badly. They have shown no remorse. She wanted them to be set on fire. The way these men assaulted her I cannot tell you. But the world knows. The world stood behind us and fought with us. These men should be hung till death because they don't deserve to live in our society.” Father of the girl said, “We are all waiting in anticipation. This is an important verdict not only for us but for the whole country. If they are not sentenced to death then it is a matter of shame for the entire country.”

Ten days ago, the Juvenile Justice Board verdict bitterly disappointed the parents. One of the attackers, who was over 17 at the time of the assault, was sentenced to three years in a reform centre, the maximum punishment for a juvenile found guilty of rape and murder.
