Hyderabad: The vacation Bench of the High Court at Hyderabad comprising Justice C Praveen Kumar and Justice Challa Kodandaram on Wednesday refused to take on file a writ petition filed by the Hyderabad Cricket Association (HCA) questioning proceeding before a three-man Arbitration Commission. The HCA is before the Commission of Justice Eshwar Prasad, Justice Motilal B Naik and Raviinder Vikram.

The dispute is at the instance of Vishaka Asbestos, a company, which have multiple commercial claims against the HCA. It was contended by it that the agreement was unilaterally terminated by the HCA without the authority of law. The claimant then moved the proceedings for the Arbitral resolution of the dispute. The Bench pointed out that prima facie it was not permissible to maintain a writ plea against arbitration proceedings. The Bench, however, directed that the matter be listed after the Sankranti vacation.
