Farmers can’t be forced to be part of land pooling for capital: HC. The two-judge PIL bench of the High Court at Hyderabad on Tuesday declared that farmers cannot be forced to be part of the Land pooling for the creation of the new capital for the state of AP.

Hyderabad : The two-judge PIL bench of the High Court at Hyderabad on Tuesday declared that farmers cannot be forced to be part of the Land pooling for the creation of the new capital for the state of AP. The bench comprising acting Chief Justice Dilip B Bhosale and Justice SV Bhatt disposed of a batch of writ pleas questioning the provisions of the Land Pooling Scheme, evolved by the A.P.

Capital Region Development Authority Act, 2014 along with the related Notification as illegal, invalid and unconstitutional. The batch of writ pleas filed by land owners of the Krishna and Guntur districts whose lands are pooled for the purpose of acquisition also sought a declaration that the lands of the petitioners can only be acquired under and in accordance with the "Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Re-settlement Act, 2013".

Though the petitioners sought a declaration that the provisions of the A.P. Capital Region Development Act, 2014 as unconstitutional being repugnant to the Central Act, 2013, the said plea was insisted upon . The bench made clear that the government must acquire the lands if still required by if in accordance with the provisions of the Land Acquisition Act. The bench even made clear that the farmers can continue with agricultural operations till their lands are acquired in accordance with law.
