Hyderabad: The two judge PIL bench consisting of Acting Chief Justice Dilip B Bhosale and Justice SV Bhatt directed the government to produce the government order which specified the period within which the election for the Water User Association, Distributor Committees and Project Committees can be completed.
The bench further directed the government to file an affidavit indicating the time within which the election process can completed.It was contention of the petitioner that the government was not conducting elections of Water User Association,
Distributor Committees and Project Committees as required under the Act II of 1997 for almost three years and to have appointed a body to handle the vacant position till the positions were filled through elections as arbitrary, illegal and unconstitutional.
The matter was adjourned to October 26.
4.The two judge PIL bench consisting Acting Chief Justice Dilip B Bhosale and Justice SV Bhatt adjourned the writ plea filed seeking action against the district collectors and others in not taking any action of the ongoing illegal sand mining mafia in the district of Mahabubnagar.
It is the contention of the petitioner that farmers were killed for questioning the illegal transportation of sand from their agricultural lands without having any permits, way-bills, transit permit and without payment of signiorage fees. The government informed the bench that it would need some more time to get information and till now only two districts have responded back with information.
The bench on request of the government adjourned the matter to October 26. A two judge bench of the High Court at Hyderabad on Wednesday refused to grant permission to a mass hunger strike in Guntur district. The bench comprising Acting Chief Justice Dilip B Bhosale and Justice SV Bhatt was dealing with a petition filed by M Nagaiah Madiga, working president of Madiga Reservation Porata Samithi.
It is the case of the petitioner that the party had requested the Guntur district police to grant it permission to conduct a mass hunger strike onOctober 8 at Thullur mandal in the district protesting against the land acquisition by AP government to take up construction of new state capital in CRDA region.
He pointed out that the party had already invited many people to address the gathering but the authorities neither granted permission nor denied permission. Counsel appearing for the government informed the court that the permission was denied for the event on security grounds as there was another event taking place on the proposed day.
He said the government had no problem in granting permission if the protest would be conducted onOctober 22. Refusing to direct the police authorities to grant permission, the bench dismissed the matter.
