Hyderabad: Justice A Ramalingeshwar Rao of the High Court at Hyderabad set aside the action of the government of Telangana and the Telangana Cooperative Bank Limited in the case of tenders for providing end-to-end ATM switching services on hosted application service providers.

The AP State Cooperative Bank had floated a request for proposal prior to the bifurcation of the State and the same was kept pending the bifurcation.

The Petitioner Finacus Solutions Private Limited challenged the action of the authorities in considering the tender offer of Euronet Services India Private Limited.

Dealing with the question as to whether the stated disqualification was a major or minor disqualification, the judge pointed out that the APCOB had itself pointed out that the certification was necessary for Information Security standard.

The judge ruled that it was not a minor eligibility. Though the respondents took the plea that the courts must be slow in dealing with matters relating to tenders and contracts,

the judge pointed out that the action of the authorities in granting relaxation of an essential tender condition was contrary to law and accordingly set aside the decision to award the contract.
