A two-judge bench of the Apex Court comprising Justice Deepak Misra and Justice N Nagappa on Thursday rejected Special Leave Petitions (SLP) of the Medical Counsel of India (MCI) and directed counselling to fill up vacant seats in government medical colleges at the post-graduate level within two weeks. 

Hyderabad: A two-judge bench of the Apex Court comprising Justice Deepak Misra and Justice N Nagappa on Thursday rejected Special Leave Petitions (SLP) of the Medical Counsel of India (MCI) and directed counselling to fill up vacant seats in government medical colleges at the post-graduate level within two weeks.

Such counselling, however, will only be for students who have not been admitted so far. This would directly affect seats in the States of AP, Telangana and Delhi universities. It may be recalled that a division bench of the High Court had directed such counselling even after the cut-off date on the ground that there would be a huge dent in the public exchequer.

Simhadri, appearing for petitioners Dr Apoorva and others, pleaded that the order of the High Court was justified in view of the huge public wastage. The bench rejected the arguments of VVS Rao who appeared for the In-Service Doctors. Senior counsel Prashant Bhushan appeared for the students from Delhi and Simhadri for the students from Hyderabad.
