The amount of GBP 1,007,940.09, shillings belonging to H.E.H Sir Nawab Mir Osman Ali Khan Bahadur Nizam Vii was transferred in National Westminster Bank UK, now called as Royal Bank of Scotland in the account of the then Pakistan High Commissioner Rahimtoola in September 1948 by the Nizam VII Finance Minster Mir Moin Nawaz Jung. The Nizarn brought a civil action suit against his Finance Minister and Rahimtoola for illegal transaction. However, the proceeding was stayed in 1957 by the House of Lords after Pakistan claimed sovereign immunity.
Now, the latest dispute is over the same account which is now GBP 34 million lying in Royal Bank of Scotland UK. It has being revived in the High Court Chancery in London after 66 years by the present High Commissioner of Pakistan to U.K.
In April 2013 the Pakistan High Commissioner proposed to initiate a Civil Action against the Bank for release of the money saying it has legal title over the Nizam Money. But in November, 2013 it again approached the court serving a notice of discontinuance of proceedings. Pakistan has voluntarily submitted to the jurisdiction of the court and waived its sovereign immunity.
India being a party to the case has written to the bank saying they claim the money but don't need to do more at this stage. The bank has also made it clear that it will not release the money unless the British court specifically pass an order directing it to release the funds in, favor of rightful claimants.
In 2008 we met the Prime Minster, Foreign Minister and Foreign Secretary of India requesting them to solve the issue amicably. Since 2005 we have met with 3 Pakistan High Commissioners in New Delhi. We also appealed to the Pakistan President Asif Ali Zardari to resolve the matter through out of court settlement. From then we have been in correspondence with the concerned Authorities.
Now that the six decades long issue seems_ to see the light of the day and only one son and three daughters' of Nizam VII are alive, the family members hope this issue gets resolved promptly.
Nawab Najaf All Khan is representing the Nizam Family Members in the High Court U.K other than Prince Mukarram jah and Prince Mukaffam jah who are also the two Grandsons of the Nizam VII claiming the amount.
