Supreme Court Clears Decks For Telangana. The Supreme Court on Monday refused to stay the Notification on the creation of Telangana, following the bifurcation of Andhra Pradesh.

New Delhi: The Supreme Court on Monday refused to stay the Notification on the creation of Telangana, following the bifurcation of Andhra Pradesh. The Supreme Court has posted the case to August 20 for the next date of hearing, making it clear that the coming into being of Telangana and Andhra Pradesh on June 2 will not be stopped.
Supreme Court advocate D Ramakrishna Reddy said that the Supreme Court has cleared the decks for the coming into being of Telangana and Andhra Pradesh on June 2. Now that the case has been posted to August 20, by the time the issue is adjudicated upon, the State formation process would have been completed.
The Supreme Court Bench comprising Justice H L Dattu, Justice M Y Eqbal and Justice Sharad Arvind Bobde, declined to either stay the Notification or to conclude the hearings and give interim orders before June 2.
Justice H L Dattu pointed out that the Centre is yet to respond to the Notices issued by the Apex Court, although the Andhra Pradesh Government has responded to it. The court can proceed in the matter without hearing the version of the Central Government.
When Rajiv Dhavan, appearing for the petitioners, who included former Andhra Pradesh Chief Minister N Kiran Kumar Reddy, said injustice was done to them, some advocates joined the chorus, to which Justice H L Dattu took strong objection and admonished them. He said that the Apex Court will take into account all alleged violations of Constitutional provisions while hearing the matter in August and will not dither from issuing any orders if the notification was found illegal. The petitions have claimed that no such notification could have been issued since the Andhra Assembly had unanimously rejected the proposed Bill for bifurcation the State.
