New Delhi: A two-member Supreme Court bench consisting Justice Jagdish Singh Khehar and Justice Banumathi on Wednesday dismissed the civil appeal of the TS, AP governments with regard to the Common Service Rules of Teachers as the State governments' had no right to do so.

The apex court upheld the earlier High Court order which it found to be good. This brings down curtains on a long-drawn battle between the government and the local body teachers of the two States.

It also indicated that the Central government should seek the Presidential decree in a fixed time, thus leaving the ball in the Centre's court.

It may be recalled that during the last hearing, Senior Counsel P P Rao, representing the AP government, had pointed out that the State government had written a letter to the Home Ministry forwarding a copy of the resolution adopted by the Assembly in favour of Common Service Rules and seeking its approval.

Responding to the same, the Director (Centre-State) of the Union Home Ministry, Ashutosh Jain, wrote back to the government clarifying that "as the court has ordered maintenance of status quo in the matter,

despite the stand of the State government that the Central government is not a party in the proceedings and therefore not bound or governed by the same,

it may be appropriate that the proposed Presidential Order may be issued only after seeking the leave/permission of the Court. It is therefore requested action may be initiated to seek the leave of the court".

Wednesday's order now paves way for the Home Ministry to initiate appropriate measures in this regard if the State governments insist on Common Service Rules.

As the apex court dismissed the petition, the teacher unions in both States stated that in wake of bifurcation of united Andhra Pradesh, both Telangana and Andhra Pradesh governments should form new service rules for the teachers.

“The government should immediately take steps for making new service rules for the teachers and should get presidential nod at the earliest,” said Chava Ravi, General Secretary, Telangana United Teachers Federation.

Meanwhile, welcoming the SC’s verdict, AP United Teachers Federation president I Venkateswar said the apex court judgement would pave way for filling up the Mandal Educational Officers,

Diet lecturers and Deputy District Educational officers posts which have been vacant for the last 12 years.
