Already the nation is suffering from the self-proclaimed leaders, intellectuals and God men. And then there are media and NGOs. To add to the existing confusion, now Judiciary, the elitist but weakest pillar of Indian democracy has walked into the fray. No doubt, they will win hands down.
In fact, this shows how casteism has established itself and consolidated over time. If every state can boast of at least two to three families consolidated in politics within seven decades of electioneering, it doesn’t need much intelligence to guess how this could evolve in few centuries.
It is self-preservation of communities that usurp rights of exclusivity over something that over a period of time stabilises into something like the casteism. Despite being a democratic country, India had become a hub of regional satraps with one family having rights of ruling at national level. Is this democracy, in its true form? Already, few decisions of the Government reserving jobs for children of employees in few organisations had already made getting employed in some elite organisations as a family affair.
Despite being appointed by other agencies, the policy of “You scratch my back and I’ll scratch yours” had already made quid-pro type of largesse popular. It is noteworthy to recognise the fact that over a period of time, nearly all constitutional posts and important portfolios have got a sort of recruiting mechanism in place, and it was the Judiciary that played vital role in establishing these.
Despite Supreme Court and High Courts have been largely unaffected by the corruption, the same cannot be said for the lower courts. The way higher judiciary reacted actively to tighten the screws of democracy and administration, for some strange and inexplicable reason, it didn’t act to iron out things within judiciary.
Almost in every annual judicial functions, we hear the CJI cringing how the volume of pending cases is increasing and how lack of funds have affected them from constructing new courts and hiring brilliant minds.
When the judiciary can order the Government on so many others, I wonder why they have not shown the same type of urgency and stringency in getting more funds and solving pending cases. Is it a great thing to keep cases from pre-independence time still in courts?
Justice not only to be done, but seen to be done that Justice is done.
Even Judiciary agree that the collegium system is not fool proof. And, the judiciary that was active in the last two decades on so many matters that concerned commoners, has failed to put its house in order.
And by usurping power to recruit new brethren themselves, I know for sure the Judges could not answer their own conscience after ensuring that they laid foundation to disrupt the balance of constitutional pillars and have acted against the parliament that represents the people and their will. Yes, people need to be guided and shown better way of living – for which, the judiciary first shall act upon itself before preaching the same to politicians.
