Justice MS Ramachandra Rao passed these orders while dealing with a Writ petition filed by D. Anthamma and two others from Meerkhanpet Village, Kandukur Mandal Ranga Reddy District against the Notification issued by Joint Collector-1, Ranga Reddy district on 23-09-2016 through which 314 acres of land in Survey No. 112 of Meerkhanpet village was sought to be alienated to Telangana State Industrial and Infrastructure Corporation (TSIIC) for setting up Green Pharmacity in the region.

These were poor farmers who had been assigned lands by the Government over different periods of time, which are now being sought to be resumed for the project.

The petitioners contended that the Notification issued by Joint Collector-1 invoking GO MS No. 45 issued by Industries and Commerce department was intended to frustrate the orders of the High Court that had stayed all further proceedings related to resumption of 493 acres of land in the said Survey No. 112 on 17-08-2016 itself.

The court had in another related case stayed the operation of GO MS No. 45 itself on 14-09-2016. Now, out of the total 493 acres in Survey No.112, the authorities have issued notification for resuming 314 acres.

In the impugned notification, the authorities expressed the intention of the Government to pay the assignees/unauthorised occupants at the rate of Rs 8,00,000 and Rs 7,70,000 respectively per acre.

Saying that by this the authorities want to frustrate the pending adjudication by the Court and that this amounted to a blatant contempt of Court, the petitioners submitted that suitable contempt proceedings will be initiated shortly against the Respondents.

The judge took serious note when the counsel for the petitioners pointed out that the names of the petitioners in the earlier Writ petition wherein the Court had granted stay, also figure in the latest notification.

He questioned how the authorities could do this and directed the Government Pleader to file their response and stayed the acquisition proceedings pending disposal of the Writ petition.
