In a setback to YSRCP MLA R K Roja, a division bench of the High Court at Hyderabad on Tuesday set aside the interim relief granted by a single judge in her suspension issue. The bench comprising Acting Chief Justice Dilip B Bhosale and Justice P Naveen Rao pronounced this order whereby the single judge Justice A Ramalingeshwara Rao has been urged to adjudicate the matter in the final hearing.
Hyderabad: In a setback to YSRCP MLA R K Roja, a division bench of the High Court at Hyderabad on Tuesday set aside the interim relief granted by a single judge in her suspension issue. The bench comprising Acting Chief Justice Dilip B Bhosale and Justice P Naveen Rao pronounced this order whereby the single judge Justice A Ramalingeshwara Rao has been urged to adjudicate the matter in the final hearing.
The bench allowed the writ appeal filed by the Andhra Pradesh government against the interim order of the single judge. It may be recalled the division bench heard the arguments of senior counsels P P Rao who appeared for AP government in the writ appeal while Indira Jaisingh argued against the appeal on behalf of Roja for the entire day on Monday.
Although the order was not available till the time of going to press, it is learnt that the bench agreed with the argument of Rao that quoting of a wrong rule does not amount to substantial illegality. More so when the House has constitutionally granted unfettered powers to regulate the conduct of errant members.
The bench wanted the single judge to come to a clear legal conclusion in the matter and therefore disfavoured the granting of interim relief to Roja. It directed the AP government to file its counter within one week before the single judge who will then take up the hearing to adjudicate the matter.
The AP government contended through its counsel that with the interim relief granted by the single judge, who suspended the Assembly motion to expel Roja for one year, there remained practically nothing substantial to be adjudicated in the final hearing. The bench seems to have agreed with this argument.
It remains to be seen whether Roja would challenge this order of division bench in the Supreme Court that had expressed its consternation at the way Roja's suspension issue was dealt with when her counsel Indira Jaisingh raised before a bench comprising Justice Gopala Gowda and Justice Arun Mishra. The bench found that Roja's petition was maintainable and directed the High Court to hear the matter expeditiously.
